By accessing and using Bonuxo you accept these Terms and Conditions. If you represent a company, you confirm you have authority to accept them on its behalf. If you do not agree, do not use the service.
The service
Bonuxo is software as a service (SaaS) that lets businesses (the "Business") create, manage and distribute digital loyalty cards stored in their customers' Apple Wallet and Google Wallet. It includes, among other features:
- A dashboard to create, design and manage cards.
- Issuing .pkpass (Apple Wallet) and .jwt (Google Wallet) files.
- QR scanning to add points or stamps.
- Customer management: import, segments and profiles.
- Reports on program performance.
- Card notifications and store proximity alerts.
- Several businesses under one account.
Bonuxo is under active development. Features may change or be discontinued; changes to critical features are announced at least 30 days in advance.
Relationship between the parties
Bonuxo is solely the Business's technology provider. It has no direct commercial relationship with end customers, who deal only with the Business that issues the card. The Business sets the program rules and rewards and is accountable to its customers.
Sign-up and account
By signing up, the Business warrants that:
- The information provided is true, complete and up to date.
- It has legal authority to accept these terms on behalf of the company.
- It will keep its credentials confidential.
- It will notify Bonuxo immediately of any unauthorized use of the account.
- It is responsible for all activity on the account.
Fraudulent, abusive or illegal activity may lead to immediate suspension or termination of the account.
Acceptable use
You agree not to:
- Use the platform for illegal or fraudulent activities or to infringe third-party rights.
- Distribute malware, spam or misleading content through cards or notifications.
- Access, copy or modify parts of the platform without authorization, or reverse engineer it.
- Deliberately overload the infrastructure.
- Resell or sublicense the service without written authorization.
- Use end-customer data for purposes unrelated to the loyalty program.
Business obligations
The Business is the controller of its end customers' data under the data protection law of its country, and agrees to:
- Have a legal basis before sending marketing to customers, including those it adds manually or that join from its point of sale.
- Clearly inform its customers about the program and how their data is handled.
- Keep the data it uploads accurate and up to date.
- Handle customers' access, correction or deletion requests within the legal deadlines, with Bonuxo's help where appropriate.
Subscription and billing
- Cycle: billed monthly in advance, according to the plan.
- Payments: processed by Mercado Pago; Bonuxo does not store card data.
- Cancellation: at any time; access continues until the end of the paid period.
- Refunds: no refunds for partial periods; exceptional cases are reviewed individually. See the full policy.
If payment is not made, Bonuxo may suspend access after 5 business days' notice.
After cancellation, the account is deactivated and the data of the Business and its customers is deleted at the account holder's request and in any case within 90 days, except records that tax law requires to be kept. Deletion can be requested via Data deletion.
Third-party integrations
Cards depend on Apple, Google and Mercado Pago infrastructure, whose policies the Business accepts by using Bonuxo. Bonuxo is not responsible for those third parties' policy changes, outages or decisions. Bonuxo does not send WhatsApp messages today.
Point of sale (Fudo) and online store (Tiendanube)
If the Business connects these integrations, it authorizes Bonuxo to read, read-only, closed sales or orders (amount, date, channel, items and the customer's phone when the sale identifies them) to add points. Bonuxo creates, changes or deletes nothing in those systems. Credentials are stored encrypted and the connection can be revoked from the dashboard.
Automatic sign-up from the point of sale
With a point of sale connected, Bonuxo may create profiles from the sale's phone number and, when the sales system provides them, the name, email and birthday (origin pos-auto). Profiles of people who never joined the program or redeemed anything are deleted automatically 90 days after their last purchase. The Business must inform its customers about this.
Intellectual property
Bonuxo's software, design, trademarks and content belong to Bonuxo. The Business keeps ownership of its brand and content and grants Bonuxo a limited, non-exclusive, revocable license to use them only to provide the service. Bonuxo uses the Business's name or logo as a commercial reference only with prior express authorization.
Data processing
The Business is the controller of its customers' data and Bonuxo is the processor, which agrees to:
- Process the data only on the Business's instructions and to provide the service.
- Keep that data confidential.
- Use only the sub-processors listed in the Privacy policy.
- Help the Business answer data-subject requests, with the dashboard request inbox and the page
register.bonuxo.com/{business}/mis-datos. - On account termination, delete the data as described in section 6.
Warranties and liability
Bonuxo is provided "as is". We aim for 99.5% monthly availability, but:
- We do not warrant uninterrupted or error-free service.
- We are not liable for outages beyond our control (force majeure, third-party failures).
- We do not guarantee campaign results, visits or revenue: they depend on the Business itself.
- We are not liable for indirect, incidental, special or punitive damages.
- Total liability does not exceed the amount paid in the 3 months before the event giving rise to the claim.
Changes to these terms
For material changes we will notify you by email and in the dashboard, and they take effect 30 days after notice. Continuing to use the service afterwards means accepting the new terms; if you disagree, you can cancel before then.
Governing law and jurisdiction
These terms are governed by the laws of the Argentine Republic, and disputes are submitted to the ordinary courts of the Autonomous City of Buenos Aires. For the personal data of customers of businesses in other countries, the data protection law of that country also applies (see the Privacy policy), and any rights that local law makes non-waivable remain in force.
